Privacy Summary:

  • You own your music. We don't claim any rights to your uploads or your samples.
  • We don't sell your private data. We only use Social Auth to keep your account secure.
  • We aren't "stealing" your sound. Your files aren't used to train music-generating AI.
  • One-click Deletion. If you leave, your data leaves with you.

1. Introduction

Neural Analog ("Neural Analog", "we", "us", or "our") provides a web service and software platform that allows users to use machine learning models to create virtual instruments (the "Service"). These combined Terms of Service and Privacy Policy ("Agreement") explain the rules for using the Service and how we collect, use, disclose, and protect personal data.

By creating an account, subscribing, uploading files, or using the Service you agree to this Agreement. If you do not agree, do not use the Service.

2. Key definitions

User Content: any audio (including full mixes or individual stems), files, metadata, or other content you upload to the Service.
Generated Outputs: files produced by the Service that derive from User Content (e.g., instrument samples, transformed audio).
Intermediate Files: temporary or derived files created during processing (transcripts, chops, transformed samples, model inputs/embeddings, analysis data).
Controller / Processor: Neural Analog acts as the controller for personal data collected to operate the Service; where we process on behalf of a user or under contract we will note processing roles. Third parties (e.g., Stripe, Supabase) act as processors or controllers for their respective services.

3. Acceptance of Terms

You must be at least 18 years old and have legal capacity to form a binding contract. Using the Service constitutes acceptance of and agreement to be bound by this Agreement.

4. Eligibility

By using the Service you represent and warrant that you are at least 18 years old and authorized to upload and license the User Content you provide.

5. Account registration & authentication

5.1 You must create an account and provide accurate information.
5.2 We support social authentication (e.g., Google, Discord) and use Supabase for account backend. Social auth is used for identity and account provisioning only, not for marketing unless you permit it.
5.3 You are responsible for account security and for all activity under your account. Notify us immediately of unauthorized use.
5.4 Google Sign-In Branding: Our implementation of Google social authentication complies with Google's Sign-In Branding Guidelines. "Sign in with Google" buttons follow Google's required design, wording, and logo usage specifications.

6. Subscriptions, billing & refunds

6.1 We operate on a subscription model with the plans and pricing displayed on our site. Subscriptions are billed in advance monthly unless otherwise stated.
6.2 Payment processing is handled by Stripe. We do not store full payment card numbers. Questions related to payment data should be directed to Stripe.
6.3 Cancellation: You may cancel anytime via your account settings. Cancellation takes effect at the end of the current billing period. You retain access until then. We do not refund partial months. 6.4 Plan Changes:

  • Upgrades: Effective immediately. You will be charged the prorated difference between the old and new plan for the remainder of the cycle.
  • Downgrades: Effective at the start of the next billing cycle. You remain on your current plan until the period ends.
  • Interval Changes: (e.g., Monthly to Yearly) Effective at the start of the next billing cycle.

7. Uploads, User Content, ownership & licenses

7.1 Ownership: You retain all ownership rights in your User Content.
7.2 Your representations: By uploading, you represent you have all necessary rights, consents, and permissions to upload and allow use of the User Content as described here (including rights from performers, co-authors, labels, or publishers where required).
7.3 Technical Permissions: To process your audio, our system needs your permission to "handle" the file. By uploading, you grant us a limited technical license to:

  • Host and Store: So you can access your files from different devices.
  • Process and Transform: So our machine learning models can generate the outputs you requested (e.g., creating a virtual instrument).
  • Anonymized Analysis: We may look at technical metadata (like file length or sample rate) to optimize our server performance.
  • Important: This does not give us the right to sell your music, release it, or claim any credit for your work. You remain the 100% owner of your original content and the outputs you generate.

Free User Track Display: If you are using the Service under a Free/non-paid plan, you explicitly agree that your User Content and Generated Outputs (including AI music platforms imports) may be set to Shared and displayed on our website (e.g., in a "Latest Uploads" or "Community" section) for demonstration and promotional purposes. This right is waived for users on active Pro plans, who may choose to keep their tracks Private via account settings.

This license does not transfer ownership and is limited to purposes described in this Agreement.
7.4 User's rights in Generated Outputs: Generated Outputs delivered to you are downloadable for your use. You will own (or have all necessary rights to) derivative works you create using downloaded Generated Outputs, subject to applicable law and third-party rights. Neural Analog does not claim ownership in your original User Content. If parts of Generated Outputs incorporate third-party elements (e.g., third-party samples), those elements may be subject to additional terms.

8. Use of inputs, intermediate files, and generated outputs

8.1 How we use uploaded audio and outputs: We process User Content to produce the downloadable Generated Outputs. Audio files are primarily hosted on cloud storage (e.g. Cloudlfare R2 in the EU Region) and are temporarily copied to high-performance remote volumes for processing (GPU inference), then deleted from the processing volume immediately after the job is done. Your User Content is not sold to third parties.

We may process and retain Intermediate Files and derived metadata (filenames, audio features such as duration or file extension, error logs) to operate, maintain and improve the Service.

Processing necessary to provide the Service (creation, storage, transformation of files) is performed on the basis of contract performance (you request the Service).
Processing for analytics, fraud detection, and security is performed on the basis of legitimate interests.
We may use aggregated or anonymized analytics to improve the Service.

8.2 Anonymization & aggregation: Where practicable we will anonymize or aggregate data used for analytics and research. However, anonymization may not always be possible depending on feature extraction and the nature of audio.
8.3 Commercial re-use by Neural Analog: Neural Analog may use transformed or derived content in the ordinary course of business (e.g., to demonstrate features, or create internal datasets) only in anonymized/aggregated form, unless you have provided separate permission.

8.4 Our AI Ethics & Training Policy: We respect the intellectual property of creators.

  • No Generative Training: We do not use your music to train "generative" models that create new music from scratch.
  • Tool Improvement: We may use anonymized technical data to improve our "Utility" models (such as noise reduction or audio restoration).
  • Your Choice: If we ever implement more advanced model tuning using user data, it will be Opt-In by default for Pro users. Your art belongs to you, not our training set.

9. Privacy

9.1 We collect and process personal data to operate the Service, manage accounts and subscriptions, provide support, and comply with legal obligations.
9.2 In-Product Privacy Notifications: In addition to this Privacy Policy, we display prominent privacy notices within the Service interface explaining data collection practices before users upload content or authenticate. These notices link directly to this full Privacy Policy.
9.3 Privacy Policy Location: This Privacy Policy is hosted exclusively at https://neuralanalog.com/terms and is linked from both our homepage footer and the authentication interface. The URL in our OAuth consent configuration matches this location exactly.

10. Our Minimal Data Approach

We believe in data minimization. We only collect the bare essentials required to provide the Service:

  • Identity: When you "Sign in with Google," we only receive your email address and name. This allows us to create your account and secure your files. We do not request access to your Google Drive, Contacts, or any other private data.

  • Your Audio: We only host the audio files you choose to upload. These are your property.

  • Technical Logs: Like any web service, we record basic technical info (IP address, browser type) to prevent fraud and ensure the site stays stable.

  • No Hidden Data: We do not ask for your phone number, physical address, or social media handles.

A. Data you provide directly

Account data: name, email, profile data from social auth providers. Purpose: account creation, authentication, support.
User Content: uploaded audio files and any accompanying metadata you provide. Purpose: to create Generated Outputs and deliver the Service.
Support communications: messages you send to support. Purpose: support and recordkeeping.

B. Data collected automatically

Usage and analytics: logs, timestamps, feature usage, error reports, IP addresses, device, browser markers (including non-PII language preferences, timezone, and device type), and performance metrics. Purpose: service operation, security, analytics, product improvement.
Billing data: payment details processed by Stripe (Stripe acts as separate controller for payment data). We receive limited payment metadata (transaction IDs) but do not store full card numbers. Purpose: billing and refunds.

C. Derived data

Generated Audio: The generated audio outputs from the Audio model.

D. Google User Data Disclosure

When you authenticate via Google Sign-In, we access only the following data from your Google account:

  • Email address: Used for account creation, authentication, and Service-related communications.
  • Profile information (name and profile picture): Used to personalize your account display.

How we use Google user data:

  • Exclusively for identity verification and account provisioning.
  • To populate your Neural Analog profile with your name and email.
  • We do NOT use Google user data for marketing, advertising, or any purpose beyond Service operation.

Storage: Google user data is encrypted in transit and at rest within our database infrastructure (via Supabase) and retained only while your account is active.

Sharing: We do not share your Google user data with any third parties except subprocessors (Supabase) necessary for Service operation.

Limited Use Compliance: Our use of Google user data complies with Google's Limited Use Requirements. We do not transfer Google user data to third parties except as necessary to provide the Service, and we do not use it for any purpose other than what is disclosed here.

11. Analytics, Cookies & Your Choices

11.1 Our Approach to Privacy: We believe you should have control over your data. We use cookies and similar technologies (like local storage) to ensure our website functions correctly, to understand how our Service is performing, and to improve your experience.

11.2 How We Respect Your Preferences: Our settings are configured to respect the highest privacy standards globally:

  • For Users in the EU/EEA/UK (GDPR): We use a "Privacy First" approach. Non-essential tracking (Analytics and Marketing) is disabled by default. These will only activate if you explicitly click "Accept All" on our consent banner.
  • For California & Global Users: We provide clear transparency regarding data usage. You have the right to opt-out of any non-essential data sharing at any time.
  • Universal Control: Regardless of where you live, you can instantly manage your privacy preferences via the "Privacy & Analytics" toggle in your Account Settings. One click will immediately stop all non-essential tracking.

11.3 Why We Use These Tools:

  • Functional (Strictly Necessary): To keep you logged in, secure your account, and process payments. These cannot be turned off as the Service would not function without them.
  • Product Improvement (PostHog/Google Analytics): To identify bugs, see which features are most popular, and ensure the site stays fast.
  • Growth (Meta Pixel): To measure the effectiveness of our outreach and ensure we aren't showing you irrelevant ads.

12. Third parties, subprocessors & transfers

12.1 Third-party services used: We use third parties to provide hosting, authentication, and payments and analytics, including but not limited to: Supabase (auth and database), Google (social auth), Discord (social auth), Spotify (social auth), Stripe (payments), Meta (analytics and advertising), Posthog (analytics), Google Analytics (analytics). We use cloud hosting and compute providers for audio processing and model compute.
12.2 Subprocessors: We require subprocessors to provide adequate safeguards and process data under our instructions. You can contact us at [email protected] if you need a full list.
12.3 International transfers: Data may be processed or hosted in jurisdictions outside your country. Where personal data is transferred outside the EU/EEA, we rely on appropriate safeguards (standard contractual clauses or similar) or other lawful transfer mechanisms.

13. Data Retention & Your Right to Vanish

Instant Deletion: When you click "Delete" on a track or your account, the source audio files are immediately flagged for removal from our active storage.

Logs and fraud: Our systems generate logs that we retain for account management, compliance, product improvement, and support. In this context, we may keep track of some data regarding your files: duration, filenames, links, metadata. For example, this is used to keep track of your weekly processing quota.

Aggregated/anonymous analytics: may be retained for product improvement.

14. Your privacy rights & how to exercise them

Depending on your jurisdiction, you may have the following rights:

  • Access — ask for a copy of personal data we hold about you.
  • Rectification — correct inaccurate personal data.
  • Erasure ("right to be forgotten") — request deletion of personal data.
  • Restriction — request restriction of processing.
  • Object — object to processing based on legitimate interests.
  • Portability — receive personal data in a structured, machine-readable format.
  • Withdraw consent — withdraw consent where processing is based on consent.

A. Specific Provisions for California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights:

  • Right to Know: You can request disclosure of the categories and specific pieces of personal information we have collected.
  • Right to Delete: You can request the deletion of personal information we have collected from you.
  • Right to Opt-Out of Sale/Sharing: You have the right to opt-out of the "sale" or "sharing" of your personal information (as defined by California law). We do not "sell" audio files, but use of certain advertising cookies may be considered "sharing."
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

B. Specific Provisions for EU/EEA/UK Residents (GDPR)

In addition to the rights above, you have the right to lodge a complaint with a supervisory authority if you believe our processing violates the GDPR.

How to exercise: Send a request to [email protected] with a clear subject line (e.g., "Privacy Request"). We may require identity verification. We will respond within the timeframes required by applicable law (e.g., 30 days for GDPR, 45 days for CCPA).

15. Security

We implement administrative, physical, and technical safeguards designed to protect personal data against unauthorized access, loss, or misuse (encryption in transit, access controls, logging). No system is perfectly secure; we will notify affected users and authorities where legally required after a data breach.

16. Minors

The Service is for adults 18+. We do not knowingly collect personal data from children under 18. If you are a parent/guardian and become aware your child has provided us data, contact us to request deletion.

17. Acceptable use & prohibited behavior

You agree not to:

  • Upload content you do not have the right to use or that infringes others' rights.
  • Upload malware, illegal content, or content intended to defraud.
  • Attempt to reverse-engineer or extract models or compromise the Service's security.
  • Circumvent payment systems or misrepresent identity or entitlement.

We reserve the right to suspend/terminate accounts that violate these rules.

18. DMCA / Copyright complaints & takedown

If you believe content on the Service infringes your copyright, send a notice to [email protected] with a DMCA-style takedown request containing all required elements (identification of the copyrighted work, location, contact details, and a sworn statement). We will respond in accordance with applicable law and may forward counter-notices to the uploader.

19. Warranties, disclaimers & indemnity

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Neural Analog disclaims all warranties (express and implied).

You agree to indemnify and hold Neural Analog harmless from claims arising from your use of the Service, your User Content, or your violation of this Agreement.

20. Limitation of liability

To the maximum extent permitted by applicable law, Neural Analog's liability for any claim arising out of or relating to the Service will be limited to the amount you paid Neural Analog in the three (3) months prior to the event giving rise to the claim (or a maximum of USD $50 if you have not paid). We are not liable for indirect, incidental, special, consequential, or punitive damages.

21. Termination & account deletion

You may delete your account by contacting support. Deletion will remove access to the Service and prompt removal of active copies of User Content. Backup copies may persist for the retention period described in Section 13.

We may suspend or terminate accounts that violate this Agreement or for legitimate business reasons. No refunds for termination for cause unless required by law.

22. Changes to these Terms & Privacy Policy

We may modify these Terms and Privacy Policy. For material changes we will provide notice (email or in-app). Continued use after the change indicates acceptance. We will provide the "last updated" date at the top.

23. Governing Law & Dispute Resolution

23.1 Governing Law: Neural Analog is operated from France. These Terms are governed by the laws of France, providing a stable and clear legal framework for our global operations.

23.2 Let's Talk First (Amicable Resolution): Most concerns can be resolved quickly by reaching out to us. In the event of a dispute, you agree to first contact us at [email protected] to attempt to resolve the issue informally and in good faith before pursuing any formal legal action.

23.3 Venue: If an informal resolution is not possible, any formal disputes will be handled by the competent courts in France. If you are a consumer residing in the EU, you may also be entitled to bring a claim in your local courts under mandatory consumer protection laws.
